Synopsis

“Digitalisation of justice is the key to increasing the effectiveness of justice systems and a highly efficient tool for enhancing and facilitating access to justice.” This statement from the European Commission’s 2023 EU Justice Scoreboard provides a concise summary of the role of digital solutions in the justice system. The current paper aims to identify trends and challenges that shape the basic framework for the application of digital tools and artificial intelligence in judicial cooperation in civil matters in the European Union. The analysis focuses on issues that highlight the complexity of applying technological advances. In addition to identifying potential risks, it intends to define directions for possible responses. The synthetising study aims to contribute to the scientific discourse by comparing practical aspects and theoretical starting points, and by summarising standards, recommendations developed by international organisations and case law as well as findings of the relevant secondary literature.
