Az online tér jogi kérdései esetjogi szemszögből

The regulation of the online environment constitutes one of the most complex legal challenges of the twenty-first century, requiring novel legislative approaches and innovative methods of legal interpretation and enforcement. The exponential advancement of digital technologies, juxtaposed with the limitations of traditional legal frameworks, has precipitated a regulatory paradigm shift both within the European Union and globally. For legislative bodies, devising a comprehensive normative Framework applicable to the digital sphere poses considerable challenges, particularly in the field of contract law, as it necessitates the incorporation of adequate protective provisions to safeguard the legal interests of contracting parties, while also ensuring that such legal solutions do not unduly hinder the dynamic development of information technology. 
This study examines the legal issues arising in the electronic domain, with particular emphasis on a specific manifestation of distance contracts – namely, online commercial transactions – and the associated aspects of consumer protection. Beyond this, the study analyses the practical application of the right of withdrawal, as well as the interpretative principles developed in the case law of the Court of Justice of the European Union.
