Az államhatalom preventív kontrollja – a kínzásmegelőzés mint új ombudsmani feladatkör

Absztrakt
A hatalom által elkövetett vagy jóváhagyott kegyetlenség egyidős az emberi társadalommal. A kínzás, a kegyetlen, embertelen vagy megalázó bánásmód különösen olyan intézményekben bukkan fel, ahol szabadságuktól megfosztott emberek élnek. Ilyen hely a börtön, a zártosztály, de akár egy zárt gyermekotthon is.
A kínzás felszámolásának leghatékonyabb módja a megelőzés. Magyarország ennek jegyében csatlakozott az ENSZ prevenciós rendszeréhez. A feladat letéteményese az ombudsman, aki zárt intézmények rendszeres, emberi jogi szempontú monitorozásával tárja fel a kínzás kockázati tényezőit, és fogalmaz meg ajánlásokat ennek megelőzéséhez.
A könyv végigvezet a kínzásmegelőzési rendszer kialakulásán és jelenlegi működésén, összefoglalja az emberi jogi monitorozás főbb alapelveit, és értékeli ezek magyarországi megvalósulását. Konklúziója, hogy az emberi jogok elméletének gyakorlatba fordítása még jelentős befektetést igényel, a monitorozás végső céljának pedig a társadalmi attitűdök megváltoztatásának kell lennie.
